Flexible approaches adopted by the Courts to vulnerable witnesses and defendants
Lexicon Limited produce regular guidance for the Judicial College in relation to ‘Examples of flexibility agreed by the courts in respect of vulnerable witnesses and defendants’. The last issue was November 2017 and can be found here. A consolidated list of previous examples is available here.
The information and examples contained in these documents may help advocates to assist the court and suggest innovative ways for the courts to adapt to the needs of children and vulnerable witnesses. It is stressed that very case and every witness is different and there is not a one-size-fits-all approach.
